Experience

The firm's clients have benefited greatly from its combined experience in criminal and commercial representation. It has represented numerous clients in pre-indictment proceedings and successfully staved off prosecutions (and the ruinous accompanying publicity) for various professionals, including a clergyman charged with rape, a lawyer accused of fraud, and a real estate developer accused of homicide as a result of the allegedly defective maintenance of one of his properties. Less dramatically, but no less importantly, the firm's clients have avoided many potentially difficult situations through the firm's timely review, negotiation and enforcement of a wide variety of agreements and commercial contracts.

The substantial trial and cross-examination experience garnered by the firm in its criminal defense practice benefits its commercial clients as well. Mr. Epstein and Ms. Weil have collaborated in advising medical professionals concerning compliance with state and federal requirements. They also have collaborated on jury trials of commercial cases representing both plaintiffs and defendants. The firm has argued and won motions, hearings, trials and appeals in virtually every state and federal court with jurisdiction over cases in New York City as well as several in neighboring counties.

Mr. Epstein's expertise is widely respected and he has published several articles in the criminal law and legal ethics fields. An article concerning the ethical implications of attorney/client disagreements with respect to choosing a theory of defense was published in The Champion, the Journal of the National Association of Criminal Defense Lawyers. Both the New York Law Journal and The New York State Association of Criminal Defense Lawyers have featured articles by Mr. Epstein concerning litigation strategies under the Federal Sentencing Guidelines.

Mr. Epstein's cases include multiple acquittals and hung juries in criminal trials in the United States District Courts for the Southern and Eastern Districts of New York and reversals on criminal appeals in the United States Court of Appeals for the Second Circuit. He is one of a small number of attorneys eligible to defend individuals facing the death penalty in New York and has successfully represented several such clients.

An expert on legal ethics, Mr. Epstein has also testified as an expert witness in Nassau County Supreme Court on behalf of a plaintiff who prevailed in an attorney malpractice action. While much of his practice is devoted to more serious crimes, Mr. Epstein has also developed expertise in representing individuals charged with motor vehicle offenses, such as driving while intoxicated. Although these cases rarely result in jail sentences, they can have a major collateral impact, such as loss of driving privileges, which is often underestimated by clients and lawyers unfamiliar with the field.
